These Terms & Conditions of Sale (“Terms”) apply to all purchases made through the websites operated by Life Fitness Australia Pty Ltd (ABN 98 079 300 815) trading as Life Fitness Australia and associated brands, including but not limited to:
Throughout these Terms, “Life Fitness Australia”, “we”, “us” and “our” refers to Life Fitness Australia Pty Ltd.
These Terms incorporate our Privacy Policy, Website Disclaimer and any other policies referenced throughout the website.
By accessing our websites, using our services, or purchasing products from us, you acknowledge that you have read, understood and agree to be bound by these Terms.
1. WEBSITE USE
You agree to use our websites and services only for lawful purposes and in accordance with these Terms.
You must not:
- use the website for any unlawful, fraudulent or malicious purpose;
- interfere with the operation or security of the website;
- reproduce, duplicate, copy or exploit any part of the website without written permission;
- upload viruses, malicious code or harmful material;
- misuse any content, imagery, trademarks or intellectual property displayed on the website.
We reserve the right to suspend or terminate access to our websites or services at our discretion if we believe these Terms have been breached.
2. ACCESS & ACCOUNTS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You may be required to create an account to access certain services or place orders.
You are responsible for:
- maintaining the confidentiality of your account credentials;
- ensuring all information provided is accurate and current; and
- all activity conducted under your account.
You must notify us immediately of any unauthorised use of your account.
3. PRODUCTS AND SERVICES
We make every effort to ensure product descriptions, specifications, pricing and imagery are accurate and up to date. However:
- colours and appearance may vary depending on your device;
- specifications may change without notice;
- stock availability may vary; and
- errors or omissions may occasionally occur.
We reserve the right to:
- correct any errors or inaccuracies;
- modify product information;
- discontinue products;
- limit purchase quantities; or
- cancel orders where required.
All products are subject to availability.
4. ORDERS
By placing an order through our website, you are making an offer to purchase products subject to these Terms. Life Fitness reserves the right to accept or decline your order for any reason at its discretion.
Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted.
An order is not accepted until:
- payment has been received and processed; and
- we issue an order confirmation.
We reserve the right to refuse or cancel any order at our discretion, including where:
- products are unavailable;
- pricing or product information is incorrect;
- fraud or unauthorised activity is suspected; or
- we are otherwise unable to fulfil the order.
If we cancel an order after payment has been processed, we will attempt to notify you by contacting the e‑mail and/or phone number provided at the time the order was made, and a refund will be issued.
You agree that products purchased are for personal, commercial or business use only and not for unauthorised resale.
5. PRICING AND PAYMENT
All prices displayed on our websites are in Australian Dollars (AUD) unless otherwise stated.
Prices may change without notice.
You agree to pay:
- the purchase price displayed at checkout;
- applicable delivery and installation charges; and
- any applicable taxes or fees.
We currently accept approved payment methods including credit cards, PayPal and other payment providers displayed at checkout.
By making payment, you warrant that:
- you are authorised to use the payment method;
- payment information provided is accurate; and
- payment will be honoured by your financial institution.
If payment is declined, reversed or unpaid for any reason, we may:
- suspend or cancel the order;
- withhold delivery; and
- recover any costs incurred.
6. DISCOUNTS, PROMOTIONS AND COUPON CODES
We may offer promotions, discounts or coupon codes from time to time.
Unless otherwise stated:
- promotions cannot be used in conjunction with other offers;
- promotions apply only during the advertised promotional period;
- promotions apply to full-priced items only; and
- coupon codes are non-transferable and not redeemable for cash.
We reserve the right to modify or cancel promotions at any time.
7. SHIPPING, DELIVERY AND INSTALLATION
7.1 Delivery Areas
We currently deliver within Australia only unless otherwise agreed in writing.
7.2 Delivery Charges
Delivery charges are calculated at checkout.
As you know, technology is great but it’s not infallible. If there’s an error in the calculation of your postage costs, we’ll contact you before processing your order to discuss options (such as paying any additional costs or modifying your order).
Our delivery service providers may change their fees from time to time, and so you acknowledge and agree that we can vary the postage fees applicable to orders at any time on notice, and that such notice is given by posting the updated postage fees on the Website.
Missed deliveries or failed site access will incur a re-delivery fee.
Delivery charges are non-refundable if cancelled on the day of installation.
7.3 Dispatch and Delivery Timeframes
Delivery times may vary between orders.
Orders are generally processed within 7–14 business days after payment is received.
Delivery timeframes are estimates only and may vary due to:
- stock availability;
- freight carrier delays;
- remote delivery locations;
- peak periods; or
- circumstances beyond our control.
We are not liable for delivery delays.
For large equipment deliveries, at least 14 days notice is required to reschedule installation or delivery dates.
7.4 Delivery Address
You are responsible for ensuring all delivery details are accurate and current.
If an order is returned due to incorrect details supplied by you, additional freight charges will apply.
7.5 Site Access Requirements
The freight delivery service you receive may vary among carrier companies. Please note: freight couriers are one person operators and due to safety regulations do not deliver inside homes. Delivery is typically made to the front door if it is reasonably easy to access. This is at the drivers discretion. Large fitness items typically weigh in excess of 50kg+ and will require customer assistance when delivered. If the customer requires a tailgate, this will incur an additional charge payable before delivery.
Site Access Terms & Conditions for large fitness equipment:
- Double Door Access
- No Staircase or restricted Hallway
- Parking must be within 10 metres
- Pets and/or dogs on the property must be restrained from the time our delivery and installation representatives arrive on site and for the duration of the work being carried out.
- Customer must declare and provide a detailed description of any Site Hazards/Access Limitations which may present themselves during any work carried out by delivery and installation representatives.
By completing your order, you acknowledge the above Terms & Conditions. If these conditions are not met, additional freight and installation charges will apply.
7.6 Risk and Title
Risk in products passes to you upon delivery to the nominated address.
Where authority to leave has been provided, delivery is deemed complete once goods are left at the nominated location.
Title to goods remains with us until full payment has been received.
7.7 Orders Lost or Damaged in Transit
When we dispatch your order, we will give you a tracking code for you to track the progress of your order.
If you’re concerned that your order has been lost or misdelivered, we ask that you contact us as soon as possible, so that we can investigate. You understand that while we’ll investigate your missing order, we make no representations as to responsibility or liability for any lost or misdelivered order. In the event of items lost or damaged in transit, you acknowledge that our liability is limited to the amount of any compensation we are able to recover from the delivery service provider, less our reasonable costs of investigating and applying for any compensation, unless otherwise required by law.
8. EQUIPMENT INSTALLATION AND HOLD HARMLESS
Certain equipment must be bolted or secured to flooring to prevent tipping, rocking or displacement.
You acknowledge that:
- installation may require drilling into flooring or subflooring; and
- you accept responsibility for any resulting alterations.
Products requiring or recommended for floor fixing may include:
- HD Athletic Rigs;
- HD Athletic Bridges;
- HD Athletic Perimeters;
- HD Elite Racks;
- SYNRGY systems;
- PWRplay systems;
- Keiser Functional Trainers; and
- selected plate-loaded or assisted training equipment.
By purchasing applicable products, you agree to indemnify and hold harmless Life Fitness Australia against claims arising from failure to properly secure or use the equipment, except where liability cannot legally be excluded.
9. AUSTRALIAN CONSUMER LAW
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, which forms Schedule 2 to the Competition and Consumer Act 2010 (Cth) (ACL). If you are an Australian consumer for the purposes of the ACL, you are entitled to replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes any right, guarantee or warranty you’re entitled to by law, however we do exclude all other guarantees, conditions and warranties to the maximum extent permitted by law. We also specifically exclude liability for negligence.
Wherever possible, our liability for breach of any condition, warranty or guarantee is limited, at our option, to:
- replacement of the product;
- repair of the product;
- payment of the cost of having the product repaired; or
- such other fair and reasonable remedy as we are ready and willing to provide.
We won’t be liable for any consequential loss or damage or other direct or indirect loss or damage, except where we are unable to limit or exclude such loss under the ACL.
If for any reason the ACL doesn’t apply to an order you place with us (for example, if you purchase the product for re-sale with our authorisation or if you are purchasing from outside Australia), then we exclude all liability to you and we’ll only refund an order placed if we can’t fill it, if we think it’s reasonable to do so, or otherwise as agreed in writing. Please choose carefully as we do not offer refunds for change of mind.

10. REFUNDS AND RETURNS
Please choose carefully as we do not provide refunds for change of mind.
If products are damaged, faulty or incorrect upon delivery, please contact us as soon as possible.
You can choose a refund or exchange if an item has a major problem. This is when the item:
- has a problem that would have stopped someone from buying the item if they had known about it
- is unsafe
- is significantly different from the description
- doesn’t do what we said it would and can’t be easily fixed
If the problem is not major, we will repair the item within a reasonable time. If it is not repaired in a reasonable time, you can choose a refund or replacement.
We may request:
- proof of purchase;
- photographs of the issue; and
- further information regarding the fault.
Where required under the ACL, we will provide an appropriate remedy including repair, replacement or refund.
11. INTELLECTUAL PROPERTY
All website content, branding, logos, product information, graphics, videos, designs and intellectual property displayed on our websites remain the property of Life Fitness Australia Pty Ltd or its licensors.
You may not reproduce, distribute, modify or commercially exploit any content without prior written permission.
12. THIRD-PARTY SERVICES AND LINKS
Our websites may contain links to third-party websites, services or tools, including payment gateways and ecommerce platforms.
We do not control and are not responsible for third-party services, content or privacy practices.
Your use of third-party services is subject to their own terms and conditions.
13. PRIVACY
Your use of our websites is subject to our Privacy Policy, available on our website.
By using our websites, you consent to the collection, use and disclosure of your information in accordance with our Privacy Policy.
14. FEEDBACK AND USER CONTENT
If you provide reviews, suggestions, feedback or other content to us, you grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce and publish that content for marketing, operational or promotional purposes.
You warrant that:
- the content is accurate;
- you own or have permission to submit it; and
- it does not infringe the rights of others.
15. DISCLAIMER
Information provided on our websites is general information only and does not constitute professional, fitness, medical or health advice.
You should seek appropriate professional advice before relying on any information or commencing any exercise program.
To the maximum extent permitted by law, our websites and services are provided “as is” and “as available” without warranties of any kind except those required by law.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Life Fitness Australia Pty Ltd, its directors, employees, contractors and affiliates are not liable for:
- indirect or consequential losses;
- loss of profits, revenue or business opportunity;
- data loss;
- delivery delays;
- website interruptions; or
- third-party service failures.
Our total liability in connection with any product or service is limited to the amount paid for that product or service.
Nothing in these Terms excludes liability that cannot legally be excluded.
17. EVENTS BEYOND OUR CONTROL
We are not responsible for delays or failures caused by events beyond our reasonable control including:
- natural disasters;
- freight disruptions;
- supply shortages;
- strikes;
- system outages;
- acts of government; or
- extreme weather events.
Where significant delays occur, we will attempt to provide updates and suitable solutions where possible.
18. TERMINATION
We may suspend or terminate access to our websites or services at any time if:
- these Terms are breached;
- fraudulent or unlawful activity is suspected; or
- continued access may expose us to risk or liability.
Termination does not affect accrued rights or obligations.
19. DISPUTE RESOLUTION
If a dispute arises, both parties agree to first attempt to resolve the issue in good faith.
If the dispute cannot be resolved within 30 days, the parties agree to attempt mediation in Victoria, Australia before commencing legal proceedings, except where urgent interlocutory relief is required.
20. GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia.
You agree to submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
21. CHANGES TO THESE TERMS
We may update these Terms from time to time by publishing revised Terms on our websites.
Changes take effect immediately upon publication unless otherwise stated.
Continued use of our websites and services constitutes acceptance of the updated Terms.
22. SEVERABILITY
If any part of these conditions is found to be void or unenforceable by a Court of competent jurisdiction, that part will be severed, and the rest of the agreement will remain in force.
